Terms and Conditions of Sale

Herts Special Vehicles

These Terms and Conditions apply to all sales, orders, and transactions made with Herts Special Vehicles (“we”, “us”, “our”). By purchasing from us, you agree to the terms set out below.

Orders

2.1 All orders are subject to availability and acceptance.
2.2 We reserve the right to refuse or cancel any order at our discretion.
2.3 An order is only confirmed once payment or deposit has been received and acknowledged.

Pricing

3.1 All prices are shown in GBP (£).
3.2 Prices may change at any time without notice.
3.3 Prices exclude VAT where applicable unless stated otherwise.
3.4 Errors or omissions in pricing may be corrected and we reserve the right to cancel affected orders.

Payment

4.1 Full payment must be made before collection unless otherwise agreed in writing.
4.2 We accept payment by bank transfer only
4.3 Deposits are non-refundable unless otherwise agreed.

Collection Only Policy

5.1 All vehicles, parts, and goods are collection only.
5.2 We do not offer delivery or shipping services.
5.3 Customers must arrange collection directly from our premises.
5.4 Collection is by appointment only.
5.5 Suitable transport and securing equipment are the customer’s responsibility.
5.6 Risk transfers to the customer once goods leave our premises.

If a third-party courier or transporter is used, this is entirely at the customer’s risk.

Inspection on Collection
6.1 Customers must inspect goods at the time of collection.
6.2 By removing goods from our premises, you confirm acceptance of their condition.
6.3 Claims for visible damage or missing items must be raised before leaving site.

Returns & Refunds

8.1 Vehicles and used/off-road machinery are sold as seen unless otherwise stated.
8.2 Returns are only accepted where required by law or agreed in writing.
8.3 Custom orders, special-order parts, and deposits are non-refundable.
8.4 Faulty goods will be handled in accordance with the Consumer Rights Act 2015.

Nothing in these terms affects your statutory rights.

Warranties

9.1 Manufacturer warranties apply where provided.
9.2 Warranty claims must follow the manufacturer’s process.
9.3 Damage caused by misuse, modification, incorrect maintenance, racing, or off-label use is not covered.
9.4 We are not responsible for wear-and-tear items.

Use of Vehicles

10.1 Customers are responsible for ensuring vehicles are used safely and legally.
10.2 Off-road vehicles may not be road legal unless specifically stated.
10.3 It is the customer’s responsibility to check local laws, licensing, and insurance requirements.

Limitation of Liability

11.1 To the fullest extent permitted by law, we shall not be liable for:

• Indirect or consequential losses

• Loss of profits or business

• Damage occurring after collection

11.2 Our total liability shall not exceed the purchase price of the goods.

Nothing excludes liability for death or personal injury caused by negligence or any liability that cannot be excluded by law.

Force Majeure

We are not liable for delays or failure to perform obligations caused by events outside our reasonable control, including supply shortages, transport disruption, or extreme weather.

Privacy

Customer information is handled in accordance with our Privacy Policy and UK data protection laws.

Governing Law

hese Terms and Conditions are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.

Changes to These Terms

We reserve the right to update these Terms and Conditions at any time. The latest version will always be available on our website.
